The Ted Ajans guarantee for your trademark registration

Any sign that represents a company, carries distinctive features in the eyes of its customers, and clearly conveys the organization's corporate identity to other people and organizations is defined as a trademark. The legal protection of this sign is called trademark registration.

Protecting the brand is one of the top priorities for every branded product and design. Businesses and individuals who own a brand must take on all of the rights and responsibilities of that brand. The legal way to do this is registering the brand.

Trademark registration is known as a very important concept that gives businesses and companies an advantage. Registering your own trademark prevents other people from profiting or benefiting by using it.

In other words, with trademark registration you take ownership of all the rights to the brand that belongs to you.

In addition, by registering your trademark you gain the right to license it, transfer it, or pass it on as an inheritance later on. Trademark registration terms may vary, but in most cases they last 10 years. Once the required additional fees are paid, the registration can be extended further.

As Ted Ajans, we offer you the most systematic service so that you can gain comprehensive knowledge on this subject and receive support from professionals throughout your branding process.

Why Trademark Registration Matters Today

Protecting a brand is something that should be taken seriously from the very start of developing a business model or product. A trademark is an industrial property right, and it can only be protected through registration. In the event of a later infringement, matters such as asserting the trademark right, stopping and remedying the infringement, preventing it, and claiming compensation make trademark registration extremely important.

A criminal investigation can be requested against those who damage the trademark right. Trademark registration also matters in many other areas, such as protecting the brand against counterfeit products and acquiring domain names. Unregistered trademarks can only benefit from narrow protection under unfair competition rules.

What Are the Benefits of Trademark Registration?

Every year in Turkey, millions of fake and counterfeit products are manufactured or brought into the country from abroad. A company that has completed trademark registration against this and every similar kind of rights theft becomes the exclusive user of its trademark within its sector and within the borders of Turkey, and if it wishes, the trademark owner has the right to file a lawsuit against those who use the trademark. The various benefits of trademark registration are as follows:

  • People and companies doing business in the same sector can be prevented from using the trademark.
  • The corporate image of the company or business will be officially registered.
  • A 10-year protection period begins with the registration application.
  • The right to use internet addresses with the .tr extension will belong to the owner of the organization or company.
  • E-commerce and signage ventures will be legally protected.
  • The trademark can be used with the registered (R) symbol, and its registration status can be verified.

If you also want to take advantage of all these benefits, contact us without delay. As Ted Ajans, we are with you every step of the way in your trademark registration process.

The Trademark Registration Application Process

A trademark registration application can be filed online or with physical documents. To apply, the applicant does not need to be involved in trade or own a commercial business. Individuals can also file a trademark registration application. A separate registration application must be filed for each trademark. It is not possible to file a single application for more than one trademark.

A trademark application includes a form containing information about the applicant's identity, a sample of the trademark, and a list of the goods or services covered by the application. It also covers the technical specifications set out in the Law. Trademark registration takes place at the end of an administrative process carried out by the Turkish Patent Institute following the application. The stages of this process are as follows:

  • Publication of the application
  • Registration application
  • Delivery of the registration documents to the relevant parties, or rejection of the registration application
  • Examination and classification of the application by the Turkish Patent Institute
  • Oppositions filed against the application and the review of those oppositions

These are the stages the process includes. The stages take approximately 7-9 months in total. The trademark protection period provided by trademark registration lasts 10 years from the application date.

At the end of each 10-year period, it can be renewed for further 10-year periods without limit. Trademarks whose registration is not renewed within six months after the protection period ends are considered invalid.

The renewal request must be submitted and the renewal fee paid within these six months. The trademark does not have to be in use in order to apply. However, if the trademark is not used during any 5-year period after registration, it may be canceled.

What Is a Patent?

Patent is a term used for the protection of discoveries with theoretical properties. In other words, trademark registration describes and encompasses a range of distinct factors such as patent registration, patent concepts, and patented designs.

To obtain a patent, the product being applied for is first compared with existing products of the same nature. If it has a distinguishing feature that sets it apart from those products, its chances of being granted a patent rise considerably. Like trademarks, patents are registered by the Turkish Patent Institute. For applications with deficiencies, the applicant is given two months to remedy the formal deficiencies. For these applications, protection begins on the date the formal defects are remedied. If there are no formal deficiencies, the Turkish Patent Institute begins the examination process without the need for additional time. In that case, protection starts from the date the application was filed.

How Is a Trademark Registered?

To register your trademark, the first step is to prepare and complete, in full, the documents requested by the Turkish Patent Institute. From the moment you submit your documents to the institution, your application becomes public and the trademark name is placed under protection.

If the institution finds a deficiency in your documents, it gives you an additional 2 months. If you do not complete the missing documents within this additional time, your application is canceled. If your trademark registration application has been filed properly, the Turkish Patent Institute can begin a detailed substantive examination. If your application is found to meet the substantive requirements, it is published in the official trademark bulletin.

In the next stage, a new review process begins with the oppositions and opinions of third parties. For applications that receive no opposition, the registration procedures are completed and a registry record is created. Finally, the process is complete when the trademark registration certificate is delivered to the applicant along with the registry record.

We can carry out all of these steps for you professionally and quickly.

Information and Documents Required for a Trademark Registration Application

The documents required for trademark registration are as follows:

If the applicant is a legal entity:

  • Trademark sample (logo or other sign)
  • Certificate of activity
  • Proof of payment (bank receipt)
  • Tax certificate

If the applicant is an individual:

  • Existing power of attorney
  • Logo or sign (trademark sample)
  • Turkish ID number
  • Bank receipt

Trademark Registration Fees

Trademark application fees vary according to the number of classes of goods and services being applied for. Only the application fee changes for additional classes, and no matter how many classes the application covers, the fee for the trademark registration certificate stays the same.

Researching before filing a trademark application is an important factor in the registration process. At this stage, a search is carried out to assess the trademark's eligibility for registration. However, rather than simply checking whether the requested trademark already exists, its eligibility for registration must be analyzed in a detailed and meticulous way.

A trademark registration search can be carried out through the Turkish Patent Institute system, and it can also be conducted in detail using various programs. When searching, the services or products of the trademark must be determined in advance. Along these lines, identifying the trademark class will help the search results be evaluated more accurately.

To carry out the search, you will be asked to provide the trademark name to be searched, the company's service and product information, details of the person and organization requesting the search, an email address, and a contact phone number.

Some trademark applications identified as a result of a trademark registration search may not have been registered; they may have remained at the application stage or been rejected following an opposition. In addition, some trademark applications may be registered in certain areas of their classes but not for all other goods and services. For this reason, communicating the service and product information clearly plays an important role.

A trademark search may conclude that the trademark is eligible for application, but this does not mean the trademark will definitely be registered. Different outcomes may arise depending on opposition proceedings or other evaluations during the process.

Trademark searches can be carried out online, and once the required information has been submitted, the results are sent to the requester within 20 minutes.

Trademark registration can be carried out in Turkey as well as abroad. The trademark's eligibility for registration can be searched in whichever countries the registration will be filed.

What Are the Trademark Registration Classes?

When determining classes for trademark registrations, a classification system is applied. This system is called the trademark classification system. It is a list used to determine which field of activity a trademark application will be filed under. It is part of the Turkish Patent Institute (TPE) system. Trademark classification covers a very wide range. Within this classification, there are 45 trademark registration classes.

About Industrial Design Registration

Trademark registrations applied to industrial designs are examined under a separate heading. When we talk about design, the elements that should come to mind include form, the shape of the product, lines, color, structural features, and the various ornamentation worked onto it.

Every product has a particular design, and that is what sets it apart from other products. When it comes to industrial design, the factors that should come to mind are that the product meets consumer needs and is not driven by aesthetic concerns. In industrial design, products should have a specific functionality, be producible at low cost, and provide a high level of benefit to the consumer.

Trademark registration is the registration process that protects a brand and ensures that all the design and brand features of a manufactured product can be distinguished from other products or services.

Who Can Own a Trademark?

A trademark can consist of a pattern, a shape, any geographical indication, or a first and last name. Before registering a trademark, you should first understand what a trademark is.

  • Anyone can own a trademark.
  • Any person can apply for trademark registration.
  • The trademark registration process begins with an application that anyone can initiate and that does not require any special application method.
  • The next stage of the registration process then takes shape depending on whether the trademark remains published.

As Ted Ajans, we offer all of our clients a comprehensive range of services in this field. With our experienced specialists and professional corporate identity, we are with you throughout every process.

We should not see a brand merely as a commercial asset. Besides generating economic gain in business life, it is also what introduces the person or the registered organization to the world.

For example, an artist who registers their name prevents anyone else from using that name. This is a step the artist takes to prevent any action that could damage their reputation.

  • You should think of brand value as both a name and a value.

If you do not want the goods or services you produce to be used by other people without your knowledge, you can prevent this economic loss by registering your trademark. If you do not register your trademark, the law will not protect you.
